Feb. 2/10 OMB Witness: Miss Kozorys-Smith
Already qualified as an expert witness- Transportation Planner
Started with witness statement – retained in July 1998 – to review the information from the Rockfort application

  • Prepared various peer reviews and went to several meetings with the applicant
    - substance of evidence is about The Haul Route – Olde Base to Mississauga, to King Rd to Hurontario.
  • Cole Sherman had not identified some aspects; i.e. truck volume, the truck traffic lineup waiting at the JDCL entrance, potential haul routes to north and south, updated cost of haul routes.
  • Public in 1996/7 did not want these roads as truck routes. This EA was ultimately abandoned. 
  • 1999 Cole Sherman prepared a response letter, noted that various matters still had to be addressed – issue of an entrance system and the line up of trucks, should be a requirement to marshal queues, possibly trucks should be prevented from turning west, need data from another quarry to verify numbers, etc. requirement that all truck drivers adhere to the truck haul route.
  • Capacity issues for Mississauga Rd and King Rd and there is a need for updating the numbers on all roads if more than 2 yrs have lapsed in the study time.
  • Strongly recommend that the applicant update the application to reflect OPA 161, the different volume numbers, school bus stops, social impact, land use, etc. Note also that the roads have all deteriorated over a period of time. Cost estimates should also be updated. Need also to identify a secondary truck haul route to secondary markets. If that is recommended then that particular road would need upgrades and cost estimates. 3rd round of reviews in 2008. 2005 review was substantially more comprehensive than before; however, still a substantial amount left out.
  • The common thread is the upgrading of Olde Base Line – fundamentally Olde Base line has to be determined as a truck haul route and that happens via Regional Council. Would require an upgraded Environmental Assessment, and public consultation with no guarantees that this would proceed. Also require an entrance permit, which is also granted by the Region. All of these things beyond the control of the applicant.
  • Mississauga Rd is not approved for truck traffic and is not constructed for truck traffic. Region has not contemplated any EA to change the status.
  • It could be as late as 2018/20 before any upgrade could be done but that is assuming no appeals.
  • Region would have to negotiate with JDCL re costs and maintenance.
  • Unaddressed issues: 
    1) Secondary haul route

    2) Updated numbers re truck traffic and car traffic.
    3) Issue of whether Olde Base Line would be redesignated.

Refer to Ministry of Natural Resources exhibit: license conditions – applicant has to negotiate with the Region to get the appropriate permits.
(from Aggregate Act- H) ensure that all necessary permits have been issued prior to the issuance of the license.

  • There is a condition on the site plan with regard to the Haul Route – refers to trucks traveling south on Mississauga Rd and perhaps continuing south on that road.
  • Route to the south has not been evaluated by any of the reports.
  • Conclusions:
    1) URS should be addressing the remaining technical issues.
    2) Board needs to consider the obstacles to having an acceptable haul route.
    3) The note on the Site plan should be amended – preferred haul route is Mississauga to King Rd.

Cross Exam by Mr. Richards:

  • Very little difference between URS findings and the witness?
    -- Correct.
    Exception: Traffic to the north can be dealt with by the regulatory process
    - other exception was updating the traffic numbers – update mainly had to do with automobile traffic
  • Fundamental Question – Will Olde Base Line be upgraded as a Haul Route?
    --Answer: Decision is up to Regional Council.
  • Region of Peel is a responsible municipality, would you agree?
    --Yes.
  • If the OMB approves the Rockfort Quarry then the Region of Peel will approve???  Answer: Obviously will consider the decision of this Board. Also there is another wrinkle –  there has to be an EA completed and there is a land use issue.
    Belfountain: In 1998 there was an EA – Olde Base Line has needed upgrading for many years – structural deficiencies, inadequate base, not meeting MTO design etc. your report charts the work to be done - reconstruction of Olde Bas Line needed since1998. Peel has included money to upgrade but not to truck standards.
  • Peel Region deferred EA waiting for the outcome of the OMB Hearing. To this day Olde Base has not been improved.
  • Please refer to EA of Winston Churchill – Sept 25/09. There is a description of the Olde Base Line and Winston Churchill intersection which is to be improved so that traffic goes along Olde base line and not along Winston Churchill.
    --Answer: Not unusual for further improvements to be considered.
  • Question: You are familiar with other haul routes for quarries: i.e. Acton Quarry. You prepared a traffic assessment for the extension of this Quarry?
    --Yes
  • Jan 2009 – 60 percent larger than Rockfort – haul routes would remain the same
    --Majority of it is located in the NEC? yes.
  • Haul route travels thru the NEC for a certain distance?
    --Yes
  • Roads predominately used – 17th Sideroad , 22nd Sideroad, 4tLine, all are 2 lane roads with posted speeds of 60k?
    --Yes, that is all true.
  • Pictures of these roads in Mr. Pritchard’s report as other haul routes in the GTA – these roads have not been upgraded or changed?
    --Yes, that is right.
  • You did a land use inventory for the Acton Quarry?
    --Yes.
  • Note that the Bruce trail crosses one of these Sideroads?
    --Yes
  • The haul route goes thru Stewart Town and then past the Stewart Town School?
    --Yes.
  • There were 813 trucks per day going out of this quarry or 1626 pass bys?
    --Yes
  • There are some trucks that do head north?
    --Yes
  • Truck queuing - speaks to this in this report?
    --Yes
  • Road Improvements are not planned for any of these roads right?
    --Yes
  • Mississauga Rd is a high capacity arterial rd south of King Rd. right?
    --Correct
  • You stated that there were no studies south of King St.
    --I don’t believe there has been.
  • Answer: It wouldn’t have been done in accordance with OPA 161.
  • Final question: 12 yr process- your analysis of Pritchard’s work is reflected in your witness statement?
    --Yes
